MMS reserves the right to revise these Terms without notice to you by updating this posting. Therefore, you should visit this page periodically to review the Terms. JURISDICTION

This site is controlled and operated by or on behalf of MMS from the UK. MMS does not represent or warrant that any site materials are appropriate or available for use in other locations. If you choose to access the site from other locations, you do so at your own risk and are responsible for compliance with any and all local laws.

CHOICE OF LAW

These Terms shall be governed by and construed in accordance with the laws of North Carolina, as it is applied to agreements entered into and performed within that state. Any action brought to enforce this Agreement or matters related to this site shall be brought in either the state or federal courts of North Carolina. If any provision is deemed void, unlawful, or otherwise unenforceable for any reason, that provision shall be severed from this Agreement and the remaining provisions of these Terms shall remain in force. These Terms contain the entire agreement between you and MMS regarding the subject matter hereof.

INDEMNIFICATION

Upon MMS' request, you agree to defend, indemnify, and hold harmless MMS, its officers, directors, employees and agents, and affiliates from and against any and all losses, claims, damages, costs and expenses (including reasonable legal and accounting fees) which MMS may become obligated to pay arising or resulting from your use or misuse of the site material or your breach of these Terms. MMS shall use reasonable efforts to provide notice to you of any such action or claim and reserves the right to assume or participate, at its expense, and to assume control over, the investigation, settlement and defense of any such action or claim, in which event, you agree to cooperate with MMS.
BINDING ARBITRATION: ANY CLAIM, DISPUTE, OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PREEXISTING, PRESENT, OR FUTURE, AND INCLUDING STATUTORY, COMMON LAW, INTENTIONAL TORT, AND EQUITABLE CLAIMS) AGAINST MMS, its agents, employees, successors, assigns, or affiliates, arising from or relating to this Agreement, its interpretation, or the breach, termination, or validity thereof, the relationships which result from this Agreement (including, to the full extent permitted by applicable law, relationships with third parties who are not signatories to this Agreement), MMS' advertising, or any relate purchase SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ADMINISTERED BY THE NATIONAL ARBITRATION FORUM ("NAF") under its Code of Procedure then in effect. The arbitration will be conducted before a single arbitrator and will be limited solely to the dispute or controversy between you and MMS. The arbitration shall be held in a mutually agreed upon location in person, by telephone, or online. Any award of the arbitrator shall be final and binding on each of the parties, and may be entered as a judgment in any court of competent jurisdiction. Information may be obtained and claims may be filed at any office of the NAF.

Cancellation & Transfer Policies

Due to the advance planning required by program participants and Mountain Mystery School LLC (MMS) staff, it is necessary that we administer the following refund/transfer policy.

If for any reason, you are not accepted into the program, any payment(s) will be refunded in full.

If you cancel more than 45 days before the program date, you will receive a refund or credit, less the cancellation fee of $250.00. Credits will be held for one (1) year from the original program date, then forfeited if not used.

If you cancel 45 to 30 days before the program date, you will be charged a $500.00 late cancellation fee.

If you transfer to another program more than 45 days before the original program date, you will be charged a transfer fee of $100.00.

If you transfer to another program 45 to 30 days before the original program date, you will be charged a transfer fee of $250.00.

If you cancel or transfer fewer than 30 days before the program date (or if you do not attend), you will receive no refund or credit of fees already paid.

MMS reserves the right to cancel a program 14 days in advance of the program date if there is not sufficient enrollment. Participants will be notified of other program dates they may transfer to at no cost to the participant. MMS will not be responsible for costs incurred due to cancellations.
